User Guide - Fund Establishment (AML)

Overview

This form is used to establish a new Self-Managed Super Fund (SMSF) and includes Anti-Money Laundering and Counter-Terrorism Financing (AML/CTF) compliance requirements introduced under Tranche 2 AML/CTF laws. As of 1 July 2026, SMSF establishment is classified as a designated service, meaning Smarter SMSF has Customer Due Diligence (CDD) obligations for all individuals involved in the fund.

The form is divided into four tabs: Fund Details, Trustee & Member Details, Notify, and Payment.


Tab 1: Fund Details

Reference

Enter an internal reference for the order. This field is required and helps you identify the order in your records.

Customer Identity Verification (AML/CTF)

This is the first AML/CTF checkpoint on the form.

Field: Have you conducted identity verification on this client for AML/CTF purposes? Select Yes or No to indicate whether you have already performed identity verification on the client.

  • If Yes is selected, you must tick the following declaration:

    "I/We hereby declare that we have conducted AML/CTF identity verification for the individuals to be appointed as trustee/directors of the SMSF in accordance with the terms of the Reliance Agreement executed with Smarter SMSF."

    This declaration confirms that verification has been carried out under your firm's Reliance Agreement with Smarter SMSF. This field is required before proceeding.

  • If No is selected, identity verification will be handled via the KYC process described in the Trustee & Member Details tab.

Fund Details

Complete the following fields for the fund itself:

  • Fund Name (required): The full legal name of the SMSF.
  • State Law to Govern the Fund (required): Select the relevant Australian state or territory (ACT, NSW, NT, QLD, SA, TAS, VIC, or WA).
  • Establishment Date (optional): Enter in DD/MM/YYYY format. Leave blank if you do not want the date pre-populated in the fund's Deed and other establishing documents. Note that once established, trustees have 60 days to register the SMSF with the ATO.
  • QROPS Status: Indicate whether the fund wishes to qualify as a Qualifying Recognised Overseas Pension Scheme. This is relevant for clients transferring UK pension benefits, which are tax-free only if the receiving fund holds QROPS status.

Fund Address

Enter the fund's registered address using the address search field. If the automatic lookup does not work, tick Manual Address Input to enter the address components manually (unit/level, street number and name, suburb, state, postcode). A "Care Of" field is also available if applicable.


Tab 2: Trustee & Member Details

Trustee Details

Field: Trustee Type Select either:

  • Individuals – The fund will have individual trustees.
  • Company – Already Registered – The fund will use a pre-existing corporate trustee.

If using a corporate trustee previously ordered through Smarter SMSF, you can search for and select the company name from a dropdown.

Important note for single-member funds with individual trustees: Single-member SMSFs with individual trustees must have two individual trustees. The second trustee (Non-Member Trustee) is not a member of the fund.


Non-Member Trustee (Individual Trustee 2)

Complete the following details for the second individual trustee (if applicable):

  • Given Names, Family Name, Gender
  • Residential Address (via address search or manual entry)

🛡 KYC Verification – AML/CTF Requirement

An SMSF establishment is a designated service as from 1 July 2026 under the Tranche 2 AML/CTF laws. As part of Smarter SMSF's Customer Due Diligence (CDD) requirements, we require each director/trustee to undertake the KYC verification which is completed using Verifime.

To trigger the KYC check for the Non-Member Trustee, you must provide their email address:

  • Enter Email / Confirm Email: An email address is required to send the KYC check as part of Smarter SMSF's CDD obligations under the AML/CTF laws.

Note: A fee for the KYC verification applies for the SMSF and each individual.


Corporate Trustee

If a corporate trustee is being used, enter:

  • Corporate Trustee Name, ACN, and Date of Incorporation
  • Registered Address (via search or manual entry)

Directors

Indicate whether the company has an additional director who is not a member of the fund.

Non-Member Director (if applicable):

  • Given Names, Family Name, Gender, Residential Address

🛡 KYC Verification – AML/CTF Requirement

The same KYC process applies to the Non-Member Director. An email address must be provided to send the KYC check via Verifime.

Note: A fee for the KYC verification applies for the SMSF and each individual.


Member Details

Field: How many Members will the Fund have? Select between 1 and 6 members.

For each member, complete the following:

  • Given Names, Family Name, Gender
  • Date of Birth (DD/MM/YYYY)
  • Tax File Number (TFN): The form validates the TFN in real time and will display whether it is valid or invalid. A TFN is a unique nine-digit personal reference used to identify individuals in the tax and superannuation systems.
  • Residential Address: Search or enter manually.

🛡 KYC Verification – AML/CTF Requirement (per member)

Each member is also subject to the KYC verification requirement under Tranche 2 AML/CTF laws:

  • Enter Email / Confirm Email: Required to send the KYC check to each member. This will be completed using Verifime.

Note: A fee for the KYC verification applies for the SMSF and each individual.

Death Benefit Nominations (DBN)

Optionally generate Death Benefit Nomination templates for each member:

  • Non-binding DBN, Binding DBN, or Both

These are templates only. Customised DBNs can be completed separately via the Death Benefit Nomination order form.

Trustee Meeting Address

Enter the address at which trustee meetings will be held. This can be the same as another address on the file or a different address entered manually.

Chairperson: Select which member will serve as Chairperson of the trustee meeting.


Tab 3: Notify

Use this tab to notify a team member within your organisation about the order. Select a user from the dropdown and optionally add comments about the order to notify the person - delivered via email.


Tab 4: Payment

Enter payment details to complete the order:

  • Apply a coupon code if applicable.
  • Enter credit card details (Visa, Mastercard, American Express, or Discover): card number, expiry date, security code, and cardholder name.
  • Optionally provide an alternate email address for the receipt.
  • The Total field will display the order amount.

Submitting the Form

Once all tabs are complete:

  • Click Preview to review the order before submission.
  • Click Place Order to submit.
  • Click Save to save a draft for later.

Completed Order

The following documents are generated as part of the Fund Establishment (new SMSF) order:

  • Cover page (NB. which can be customised for CreatePlus+ subscriptions)
  • Smarter SMSF Deed 
  • Product Disclosure Statement 
  • Applications for membership
  • Trustee / Director Consents
  • Trustee Minutes
  • Register of Trustee(s) / Member(s)
  • Death Benefit Nomination templates - Binding DBN and/or Non-binding DBN (optional)
  • ATO Trustee Declarations (pre-populated)

Key points to remember:

  • SMSF establishment is a designated service from 1 July 2026 under Tranche 2 AML/CTF laws.
  • If your firm has already conducted identity verification, complete the AML/CTF declaration at the top of the form under the Reliance Agreement with Smarter SMSF.
  • If not, KYC verification will be sent to each individual via Verifime using the email addresses provided in the form.
  • A fee applies per individual for the KYC verification.
