ASIC - Availability of company names

When ordering a company, it is important that you understand that there are a number of restrictions in the naming protocols that can be used - these are set out in Schedule 6 of the Corporations Regulations 2001 - Reg 2B.6.01, 2B.6.02, 5B.3.01 and 5B.3.02

As part of an ASIC review once a company has been submitted, it will look to:

  • ascertain whether a name is identical
  • see whether the names are unacceptable for registration
  • see if the words or phrases are restricted, and find out whether consent has been provided to use restricted words or phrases
  • see is names relating to financial institutions have been used which require consent
